What are the punishments for intoxication offenses?
| DWI 1st: | Punishment ranges from 3 days to 180 days in the county jail and up to a $2000 fine. The sentence can be probated for up to 2 yrs and in certain circumstances the probation can last up to 3 yrs. |
| DWI 2nd: | Punishment ranges from 10 days to 1 yr in the county jail and up to a $4000 fine. The sentence can be probated for up to 2 yrs and in certain circumstances the probation can last up to 3 yrs. There is a mandatory 3 days to do in the county jail with a probated sentence. |
| DWI 3rd or More: | Punishment ranges from 2yrs to 10 yrs in the penitentiary and up to a $10,000 fine. The sentence can be probated for up to 10 yrs. There is a mandatory 10 days to do in the county jail with a probated sentence. |
| DWI with Child: | Punishment ranges from 180 days to 2 yrs in a state jail facility and up to a $10,000 fine. The sentence can be probated for up to 5 yrs. |
| Intox. Assault: | Punishment range is from 2 yrs to 10 yrs in the penitentiary and up to a $10,000 fine. The sentence can be probated for up to 10 yrs. There is a mandatory 30 days to do in the county jail with a probated sentence. |
| Intox Manslaughter: | Punishment range is from 2 yrs to 20 yrs in the penitentiary and up to a $10,000 fine. The sentence can be probated for up to 10 yrs. There is a mandatory 120 days to do in the county jail with a probated sentence. |
A person cannot receive deferred adjudication for any one of these crimes.
